Family In Ohio Files Suit Against Landlord For Attempted Eviction Due To Son’s ESA
Last week, a lawsuit claimed that a local landlord in Dayton, Miami Valley, attempted to evict a family because of their autistic son’s Emotional Support Dog.
Alexandria Lark moved into a rental home owned by Bizzell Enterprises on Shakespeare Avenue in West Dayton last summer. Shortly after their move, one of the company’s owners entered the property (without proper notification) and observed a dog belonging to Lark’s autistic son.
This led to the owners issuing a three-day notice to vacate, citing a lease violation for keeping a pet. The family provided a verification letter from a healthcare professional about their son’s need for an Emotional Support Animal.
The Miami Valley Fair Housing Center sent a letter on behalf of the Lark Family requesting a “reasonable accommodation” to allow the Emotional Support Animal with the Human Relations Council. This eventually led to the dismissal of eviction proceedings.
Taking a strong stance, the Miami Valley Fair Housing Center and the Dayton Human Relations Council have recently filed a complaint against Bizzell Enterprises LTD in the Montgomery County Common Pleas Court. They accuse the company of housing discrimination.
The lawsuit seeks a $10,000 civil penalty, damages, and an order to prevent further housing discrimination.
